Memorandum of police in Support of Motion for compact Judgment

Pursuant to Fed. R. Civ. P. 56(c ), Defendant Whitney Industries, Inc. (hereinafter referred to as Whitney) respect lavishy requests that this Court grants its Motion for Summary Judgment.

This action, brought by Plaintiff Nicholas Taylor (hereinafter referred to as Taylor) against Whitney arises out of the following genuine situation. All facts are undisputed.
Whitney is a large national order with approximately 1,000 employees,. Whitney decided to charge their employees who smoke an additional $100.00 per calendar month for health insurance. This decision was based both on the guilds desire to control spiraling health vexation costs and to promote a healthy lifestyle for its employees. The charge of $100.00 per month reflects the cost to the company of the increased health portion out costs attributable to smoking.



Taylor objected to the sassy policy and after brining a charge against the company with the Equal Opportunity Employment tutelage (EEOC), which was rejected, is bring a claim earlier this Court alleging that the new policy at Whitney violates the American with Disabilities Act and that his nicotine addiction is a disability within the meaning of the Act.
STANDARD FOR SUMMARY JUDGMENT
Summary judgment shall be entered forthwith if the moving papers before the court establish that there is no genuine tax return as to any material fact and that the moving ships company is entitled to judgment as a matter of law. Fed. R. Civ. P. 56(c ). Whitney impart demonstrate that there is no genuine issue as to any material fact in this case and that it consequently entitled to summary judgment.
